These Terms of Service ("Terms") govern your access to and use of the EtsyLens Chrome browser extension and related services (the "Service") provided by EtsyLens ("we", "our", or "us"). By installing, accessing, or using the Service, you agree to be bound by these Terms.

1. Description of Service

EtsyLens is a Chrome browser extension that provides AI-powered market research tools for Etsy sellers. The Service includes:

• Automated data extraction from publicly available Etsy product and shop pages
• AI-powered market analysis using Google Gemini models
• One-click data export to Google Sheets
• Keyword research and product discovery tools

The Service is provided as-is and may be updated, modified, or discontinued at any time.

2. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account & License

• The Free tier does not require registration or payment.
• Paid tiers (Starter, Pro, Unlimited) require purchase of a subscription through our payment processor (Stripe). Upon purchase, you will receive a license key to activate your subscription within the extension.
• License keys are personal and non-transferable. Each key is valid for use on one device at a time.
• You are responsible for maintaining the security of your license key.

4. Subscription & Billing

4.1 Pricing

Current subscription tiers and pricing are displayed on our pricing page. Prices are in USD and subject to change with 30 days notice.

4.2 Billing Cycle

Subscriptions are billed monthly on a recurring basis. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

4.3 Cancellation

You may cancel your subscription at any time through the Stripe Customer Portal. Upon cancellation:

• You will retain access to paid features until the end of your current billing period
• No partial refunds are issued for unused time within a billing period
• Your account will revert to the Free tier after the billing period ends

5. Usage Limits

Each subscription tier includes specific usage limits for AI analyses and data exports. These limits reset at the beginning of each billing period. We reserve the right to throttle or suspend access for excessive automated use or abuse.

6. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose or in violation of Etsy's Terms of Service
• Attempt to reverse-engineer, decompile, or disassemble the extension
• Share, resell, or redistribute your license key
• Use the Service to scrape data at scale beyond the intended usage of the extension
• Use automated tools (bots, scripts) to interact with the Service
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to collect personal data about Etsy users

7. Intellectual Property

• The Service, including its code, design, logos, and documentation, is owned by EtsyLens and protected by intellectual property laws.
• You retain ownership of any data you create or export using the Service (e.g., your Google Sheets data, research notes).
• AI-generated analyses provided by the Service are for informational purposes only. You may use them freely for your business decisions.

8. Disclaimer of Warranties

• We do not guarantee the accuracy, completeness, or reliability of AI-generated analyses. They are tools to assist your decision-making, not definitive market guidance.
• We do not guarantee uninterrupted or error-free operation of the Service.
• Revenue estimates and viability scores are approximations based on publicly available data and should not be solely relied upon for business decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETSYLENS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Third-Party Services

The Service integrates with third-party services including Etsy, Google (Sheets, Gemini AI), and Stripe. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or functionality of third-party services.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties.

12. Changes to Terms

We may revise these Terms from time to time. Material changes will be communicated by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation.
